1. Eligibility
- You must be at least 18 years old to use or submit content on HouseofFPS.
- You must comply with all applicable laws and these Terms.
2. User Accounts
- Account registration requires email confirmation.
- Only one account is allowed per user.
- You may access limited portions of the website without logging in (e.g., FAQ, Terms).
- Guests may submit clips but will only receive credit (not cash compensation).
3. Content Submission & Approval
- By submitting a video clip (“Content”), you offer HouseofFPS the non-exclusive right to use the Content if approved.
- No license is granted unless the clip is approved by HouseofFPS.
- HouseofFPS may approve or reject any submission at its sole discretion. Rejected clips will not appear in your dashboard.
4. Grant of Rights Upon Approval
Once approved, you grant HouseofFPS:
- An non-exclusive, irrevocable, perpetual, royalty-free, worldwide license to use, modify, distribute, monetize, and sublicense the Content.
- The right to include Content in compilation videos, paid advertisements, cross-promotional content, or any media now known or later developed.
- The authority to enforce copyright on your behalf, including DMCA takedowns and legal action.
You cannot revoke these rights after approval.
5. Clip Limits & Moderation
- You may submit up to 150 clips per day.
- All content is moderated for quality and compliance.
- Content may not contain offensive, illegal, or misleading material.
6. Compensation
- Approved clips are compensated at a base rate of $1 per clip.
- Special events or “bounties” may offer higher rewards.
- Payouts are issued via Stripe Express, and subject to Stripe’s own tax reporting (e.g., 1099s for U.S. users).
- You must earn at least $10 before requesting a withdrawal.
- HouseofFPS reserves the right to change payout terms or rates at any time.
7. Ownership of Platform Content
- All branding, trademarks, compilation videos, platform visuals, and other original works are owned by HouseofFPS LLC and protected by copyright.
- Users may not reuse, copy, or redistribute HouseofFPS content without permission.
8. Prohibited Conduct
You agree not to:
- Violate any laws or third-party rights;
- Upload content you do not fully own;
- Engage in spam, fraud, impersonation, harassment, or hate speech;
- Circumvent limits or exploit the platform.
Violations may result in account suspension or termination, and forfeiture of unpaid earnings.
9. Data Use & Privacy
- We collect information including email, IP address, and uploaded content.
- We use cookies and analytics tools to improve the platform.
- We do not currently support account deletion.
- All clips, including unapproved submissions, may be stored indefinitely.
10. Platform Availability & Disclaimer
- HouseofFPS is provided “as is” without guarantees of uptime or functionality.
- We are not liable for data loss, service interruptions, or content moderation decisions.
- Use the Service at your own risk.
11. Dispute Resolution & Arbitration
- Any disputes will be resolved via binding arbitration through the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration will take place in the State of Delaware, unless both parties agree otherwise.
- You waive the right to participate in any class action or collective legal proceeding.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
13. Changes to Terms
We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
